Abstract

This brief article is written in light of the Terrorist Offenders (Restriction of Early Release) Bill. I examine one obstacle to any future art.7 challenges mounted against the emergency legislation. In so doing, I query whether the judgment of the House of Lords in R. (Uttley) v Secretary of State for the Home Department should be departed from or distinguished.
