Abstract
This chapter examines the changes in mortgage law and practice arising from the EU Directive on credit servicers and credit purchasers, which will facilitate an EU market in cross-border sales of non-performing loans. A new regulatory system is proposed with a EU "passporting" system for credit servicers. The Directive will have significant consequences for mortgage and consumer borrowers, adding a layer of EU law to these activities.
