Abstract

This article argues that, while the decision of the Court of Session in Morgan Guaranty Trust Co of New York v Lothian Regional Council 1995 SC 151 has taken the first tentative steps towards reforming the law of unjustified enrichment in Scotland, it represents a very conservative and cautious start.
